    The deal to award West Ham the Olympic Stadium after the London 2012 Games has collapsed, the BBC can disclose.

    The board of the Olympic Park Legacy Company (OPLC) has ended negotiations amid concerns over delays caused by the ongoing legal dispute with Tottenham.

    The OPLC, government and Mayor of London have instead agreed the stadium will remain in public ownership.

    A new tender process will be opened for an anchor tenant who will now lease the stadium for an annual rent.

    It is understood West Ham will be bidding to become the tenant at the stadium.

    The new tender process will be launched this week and any interested bidders will have to submit proposals by January.

    Strained finances

    A fund of £50m has been set aside from public money to convert the 80,000-capacity stadium at Games time to a 60,000-seater venue afterwards.

    The post-Games stadium will be capable of hosting major athletics events and Premier League football.

    That opens the possibility for Championship football club West Ham and their bid partner Newham Council to submit a new, lower risk proposal which could still see them move in after London 2012.

    That money will help offset estimated running costs of more than £5m a year.

    The OPLC has decided to take drastic action because of the uncertainty being caused by the legal challenges from Tottenham but also Leyton Orient.

    Both clubs are contesting the original decision to award the stadium to West Ham because of their reliance on a £40m loan from Newham Council, which they say is effectively state aid.

    Spurs are seeking a judicial review of the decision and the next hearing at the High Court was due to be held next Tuesday.

    But to complicate matters further, an anonymous complaint was made to the European Commission last week which could have meant even further delays.

    And despite London Mayor Boris Johnson's ultimatum to Spurs last week to settle the dispute before next Tuesday and accept a funding package to help redevelop their White Hart Lane ground, the OPLC had lost confidence in a quick resolution.

    Public money
    The clock is ticking for the OPLC because it has set a deadline of 2014 for the new tenants of the stadium to move in.

    For that to happen, planning permission must be submitted by March 2012 to ensure w**k starts immediately after the Games.

    The prospect of a never-ending battle in the courts raised fears that the stadium could lie idle for years after the Olympics had finished.

    The other catalyst for the U-turn is London's bid for the 2017 World Athletics Championships.

    Last week's visit of the inspection team from the International Association of Athletics Federations (IAAF) was dominated by the continuing uncertainty over the stadium's future and, in particular, the running track.

    With London facing a real contest against Doha in November's vote, the government and mayor wanted to send a strong message to the IAAF that they are committed to staging the event in the Olympic Stadium.

    But the latest twist to the controversial saga will raise serious questions about how such an important decision could be thrown back into confusion with just 10 months to go to the Games.

    There will also be concerns over why another £50m of public money is going to be poured into a stadium which has already cost over £500m.

    Can't take the spuds to court as we are not in a direct challenge with them ,in the same way they could not take us to court, the OLPC are the ones that will be bounced around.


    now the way i see it and i may be wrong

    OPLC now keep the bowl in ownership
    our 125 year 'lease' is now defunct
    the tax payer will now pay for the conversion of the stadium (approx £50M)
    we now no longer need the loan from newnham (£40m)
    the Spuds court case with OPLC is now null and can go no further as we will not longer recieve the 40 big ones as this is what their case was based on.


    maybe this is a bit of a side swerve as the Gov still need to lease out the stadium after the running show.
    we could 'rent' the stadium at a much shorter lease term, conversion to the stadium already paid for , however we would lose the rights to gain cash through the naming rights.
    maybe we could also block Boris handing out the cash that the Spuds want to redevelop yid city

    it could get very messy... but might be a bit of a laugh along the journey too

    What I can't understand is why the Boris money to the yids is not "public money".
    It will be interesting to see if they bastards apply to rent it seeing as they were so determined we wouldnt get it.

    Newham withdrawal the catalyst, says Robertson

    Sports minister Hugh Robertson has claimed that Newham Council's decision to withdraw from the Olympic Stadium bidding process was 'the straw that broke the camel's back'.

    Robertson confirmed this morning that speculation surrounding West Ham's aborted move to Stratford - a joint bid with Newham Council - was indeed correct.

    The basis for the change in policy was said to be triggered by a letter from Newham Council who, despite backing West Ham all the way previously, said they were ready to withdraw from the bidding process.

    "The key point is the action we have taken today is about removing the uncertainty," Robertson said. "The process had become bogged down in legal paralysis.

    "Particularly relevant has been an anonymous complaint to the EC over 'state aid' - and the OPLC received a letter from Newham Council yesterday saying because of the uncertainty they no longer wanted to proceed.

    "That was the straw that broke the camel's back and we thought it better to stop it dead in it tracks now.

    "We know there is huge interest in the stadium out there from private operators and football clubs and crucially we remove any uncertainty. This is not a white elephant stadium where no one wants it, we have had two big clubs fighting tooth and nail to get it."

    As a result, should United wish to continue with the move - which will almost certainly have lost any large-scale backing it had from supporters of the club - the board will have to re-apply for tenancy on an annual basis, instead of holding the previously-agreed 125-year lease.

    West Ham United are looking at a plan B should they fail to become tenants of the Olympic Stadium with their chances of winning the expected re-tender only "60%", according to one highly placed source at Upton Park.

    After government ministers and the legacy company scrapped talks over the club's contentious bid to take over the venue following the London 2012 Games, West Ham confirmed they still hope to rent the stadium.

    "Only time will tell but I rate the chances at 60%," said the source. "If it does not happen then the club would have to look at plan B. [Transport] links to West Ham are not great. We would never move out of [the borough] of Newham. The Olympic Stadium is still the obvious choice."

    Now as you all know, I don't get involved in anything footbally or such, but this to me screams out "SOMEONE IS SOMEHOW MAKING A QUICK FAST BUCK FOR THEIR OWN BANK ACCOUNT WITH A FEW HACK HANDERS GOING ON ALONG THE LINE!" Now call me cynical, but you don't get to my age without being a bit suspicious of dealings where money is concerned.

    If Dave, Dave and Karen have anything at all about them, they will heed the warnings we've had so far and tell the OPLC to shove it where the sun don't shine. They need to show us 'they didn't get where they are today' by allowing arse'oles to take the piss.

    The thought of them taking a risk on this rolling one year lease, with a group of tossers that change their minds at the drop of a hat, is finguck scary .... angry2

    Oh, and wot Daz and Motty said about tarting up the Boleyn, and Hearnia is a cnut.
